The Kaheesplants.com gift card (“Gift Card”) is issued by O.com Gift Cards, Inc., a Utah corporation, and will be honored onKaheesplants.com based on the terms and conditions set forth in this document. These terms and conditions are issued by O.com Gift Cards, Inc. as the issuer of theKaheesplants.com Gift Card and govern its purchase, use, redemption atKaheesplants.com, and other terms. GENERAL TheKaheesplants.com Gift Card may only be used to buy goods onKaheesplants.com. Card balances cannot be used for the purchase of other gift cards, international orders, or other goods or services so designated in these terms and conditions. Not redeemable for cash in California, or in any other state unless required by law. Not a credit or debit card. Not reloadable. Safeguard your card - it will not be replaced or replenished if lost, stolen or used without authorization. REDEMPTION The amount used from anyKaheesplants.com Gift Card toward a purchase atKaheesplants.com will be deducted by O.com Gift Cards, Inc. from theKaheesplants.com Gift Card balance upon use. Any unused balance will be placed by O.com Gift Cards, Inc. in the recipient's "Gift Card Balance" which can be located by clicking on "My Account" and then clicking the "Account Settings" tab. If an order exceeds the amount of theKaheesplants.com Gift Card balance, Overstock.com requires that the excess must be paid with a credit card or other available payment method. To view yourKaheesplants.com Gift Card balance, click on "My Account" and then the "Account Settings" tab. LIMITATIONS TheKaheesplantsk.com Gift Card may only be used to purchase goods onKaheesplantsk.com. TheKaheesplantsk.com Gift Card may not be used to purchase otherKaheesplants.com Gift Cards. TheKaheesplants.com Gift Card may not be used for international orders. TheKaheesplants.com Gift Card cannot be reloaded, resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law. UnusedKaheesplants.com Gift Card balances may not be transferred after theKaheesplants.com Gift Card's balance is loaded into the "My Account" as described above. TheKaheesplantsk.com Gift Card may not be used for illegal or fraudulent transactions. EXPIRATION & FEES TheKaheesplants.com Gift Card does not expire and has no fees. RISK OF LOSS Take caution to safeguard theKaheesplants.com Gift Card. The risk of loss and title to theKaheesplants.com Gift Card passes to the purchaser or intended recipient upon tender to the carrier (in the case of a physicalKaheesplants.com Gift Card) or upon transmission (in the case of an electronicKaheesplants.com Gift Card). If theKaheesplants.com Gift Card is lost, stolen or used without authorization, it will not be replaced or replenished. Neither O.com Gift Cards, Inc. norKaheesplants.com is responsible if theKaheesplants.com Gift Card is lost, stolen, destroyed or used without the purchaser or recipient's permission. FRAUD O.com Gift Cards, Inc. reserves the right to close customer accounts and bill alternative forms of payment if a fraudulently obtained Gift Card is redeemed and/or used to make purchases. LIMITATION OF LIABILITY Neither O.com Gift Cards, Inc. norKaheesplants.com, Inc., including their respective affiliates and subsidiaries, make any warranties, express or implied, with respect toKaheesplants.com Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event anKaheesplants.com Gift Card is non-functional, your sole remedy, and O.com Gift Cards, Inc.’s sole liability, shall be the replacement of suchKaheesplants.com Gift Card. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. Accordingly, some of the foregoing limitation of liability provisions may not apply to you. DISPUTES Any and all disputes relating in any way toKaheesplants.com Gift Cards shall be submitted to confidential arbitration in Los Angeles, California, USA, except that, to the extent you have in any manner violated or threatened to violate O.com Gift Cards, Inc.’s or Kaheesplants.com's intellectual property rights, O.com Gift Cards, Inc. orKaheesplants.com may seek injunctive or other appropriate relief in any state or federal court in the State of California, USA and you consent to the exclusive jurisdiction and venue in such courts. Arbitration shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration shall be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise. ISSUERKaheesplants.com Gift Cards are issued by O.com Gift Cards, Inc. O.com Gift Cards, Inc. is the sole obligor and debtor to the purchaser. O.com Gift Cards, Inc. may transfer its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not O.com Gift Cards, Inc., will be the sole obligor to the Gift Card owner. O.com Gift Cards, Inc. has succeeded as the obligor and debtor for any and all Gift Cards that may have previously been issued by CardFact V, Inc. MISCELLANEOUS O.com Gift Cards, Inc. reserves the right to change these terms and conditions from time to time in its sole discretion, and any purchase of anKaheesplants.com Gift Card after such change shall constitute acceptance to these terms and conditions. Unless otherwise required by law, these terms and conditions shall be governed and construed in accordance with the laws of the State of California (without regard to principles of conflicts of laws that would call for the application of the law of any other jurisdiction).
